The scope of the Anti-Money Laundering Act (AMLA) is being extended to cover advisors and consultants who professionally participate in certain high-risk transactions, such as real estate transactions or the establishment of shell companies. These activities remain permitted, but are now subject to clearly defined due diligence obligations for the prevention of money laundering and terrorist financing. These include in particular the identification of clients, the determination of beneficial owners, as well as the documentation and clarification of the background of the business relationship. In addition, advisors and consultants must set up their organization accordingly, join a Self-Regulatory Organization (SRO), and report to the Money Laundering Reporting Office (MROS) in cases of justified suspicion.
